Yes. We can add your company name under a specific clause in our employment agreement. Our local internal counsel will review any additions of company-specific information to ensure the employment agreement remains compliant.
What are the types of employment agreements we can offer? (e.g., fixed-term, indefinite, project-based)
We can offer employment agreements for permanent (indefinite), fixed-term, part-time and hourly workers in Australia. While there are no set guidelines, it is best not to have a fixed-term employment agreement for longer than one year and not to renew a fixed-term agreement more than twice to avoid any risk of it being classified as an indefinite-term agreement.
Can we recognize seniority in Australia?
The Long Service Leave is the primary consideration for seniority. For more information, please refer here, as this depends on the state.
Depending on your supported employee’s seniority and state, we may be able to recognize the original start date in the employment agreement and back into the benefits they would have received.
Can we include benefits in the employment agreement?
Yes, benefits can be included in the employment agreement in generic terms.
Can we add variable compensation to the employment agreement?
Variable compensation can be added to the employment agreement. For commissions and bonuses, we will typically use our Variable Compensation Agreement to outline the performance or metrics that your supported employee needs to meet to be eligible to receive payment (please see our answers in the Employment Agreement Adjustments article).
