Employment Agreement Options in the US Internal
Please note that changes to our employment agreement in the United States are very limited due to the requirements of “at-will” employment in the US. Our employment agreement for the US is specifically drafted to be compliant with the various employment laws throughout the United States. Our legal team must approve all changes, and this may add additional days to the supported employee’s onboarding process.
Since employment in the United States is on an at-will basis, our employment agreements reflect this, with the exception of Montana, which has a separate employment agreement. Employees may be classified as exempt (salaried) or non-exempt (hourly), and we have a different employment agreement for each type. This classification is based partly on the job responsibilities, and partly on the job description. Seniority is not documented in our offer letter or the employment agreement since it refers to employment under a different employer, but we will recognize seniority for purposes of PTO (paid time off) accrual, pay increases, etc., as directed by you.
Can we add company-specific information to the employment agreement? Will Velocity Global review these updates?
Please note that changes to our employment agreement in the U.S. are very limited due to the requirements of “at-will” employment in the U.S. Our employment agreement for the U.S. is specifically drafted to be compliant with the various employment laws throughout the U.S. Typically, client-specific documents such as NDA (nondisclosure agreement), confidentiality agreements, etc., must be reviewed by our legal team and once approved are administered as a separate document presented during the onboarding process. Please note that review and approval of client-specific documents will add additional days to the supported employee’s onboarding process. We recommend that review of client-specific documents is completed prior to the receipt of any onboardings.
What are the types of employment agreements we can offer? (e.g., fixed-term, indefinite, project-based)
All employment agreements reference an at-will employment arrangement. This allows the employee and employer to end employment at any time and for any reason, without complication. We do not reference fixed-term, indefinite or project-based employment.
Can we recognize seniority in the United States?
Seniority can be recognized in the U.S. for the purposes of PTO (paid time off) accrual, wage increases, etc.
Can we include benefits in the employment agreement?
Any additional benefits you would like to offer (e.g., 401(k) match, additional compensation, paid time off, allowances) are documented in the offer letter.
Can we add variable compensation to the employment agreement?
Variable compensation can be documented in general terms in the offer letter.
